Terms of Service

1. Acceptance of Terms

By accessing or using Morphed (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our Service. We reserve the right to update these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

Morphed provides AI-powered image and video generation tools, including but not limited to:

  • AI image generation from text prompts
  • AI headshot generation
  • Product photography enhancement
  • Virtual try-on capabilities
  • Interior design visualization
  • Image upscaling and enhancement
  • AI video generation

3. Account Registration

To access certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

You must be at least 18 years old to create an account and use the Service.

4. Acceptable Use Policy

You agree NOT to use the Service to create, upload, or generate content that:

  • Is illegal, harmful, threatening, abusive, harassing, defamatory, or invasive of privacy
  • Contains sexually explicit material or pornography
  • Depicts minors in any inappropriate context
  • Infringes on intellectual property rights of others
  • Contains malware, viruses, or harmful code
  • Impersonates another person or entity without consent
  • Creates deepfakes or misleading content intended to deceive
  • Promotes violence, discrimination, or hate speech
  • Violates any applicable local, state, national, or international law

We reserve the right to remove any content and suspend or terminate accounts that violate these guidelines without prior notice.

5. AI-Generated Content

5.1 Content Ownership

Subject to compliance with these Terms, you retain ownership of any original content you upload to the Service. For AI-generated outputs created using our Service:

  • You own the AI-generated images and videos you create using paid credits
  • You may use generated content for personal and commercial purposes
  • You are responsible for ensuring your use complies with applicable laws

5.2 License to Morphed

By uploading content to our Service, you grant Morphed a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and process your content solely for the purpose of providing and improving the Service.

5.3 No Guarantees

AI-generated content may not always meet your expectations. We do not guarantee that outputs will be accurate, complete, or suitable for any particular purpose. You acknowledge that AI systems may occasionally produce unexpected or unintended results.

6. Credits and Payments

The Service operates on a credit-based system. By purchasing credits or subscribing to a plan:

  • You agree to pay all applicable fees and charges
  • Monthly credits reset at each billing cycle and do not roll over
  • Purchased credit packs do not expire
  • All payments are non-refundable except as required by law
  • We may change pricing with reasonable notice

7. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Morphed and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written permission.

8. Third-Party Services

Our Service may integrate with or utilize third-party AI models and services. We are not responsible for the content, privacy policies, or practices of any third-party services. Your use of such services is at your own risk.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that the Service will function uninterrupted, secure, or available at any particular time or location, or that any defects or errors will be corrected.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MORPHED AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your access to or use of (or inability to access or use) the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content

Our total liability for any claims arising out of or relating to these Terms or the Service shall not exceed the amount you paid to us in the twelve (12) months prior to the claim.

11. Indemnification

You agree to defend, indemnify, and hold harmless Morphed and its affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

You may delete your account at any time through your account settings. Upon account deletion, we may retain certain information as required by law or for legitimate business purposes.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Morphed operates, without regard to its conflict of law provisions.

14. Dispute Resolution

Any disputes arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If resolution cannot be reached, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
